New Mexico Declaration of Removal
A declaration of removal is defined as an identity theft report with a sworn affidavit.
If you are a current resident of New Mexico, you have a right to submit a declaration of removal regarding any information contained in your consumer file that you believe is a result of identity theft. Select the following link to view the complete New Mexico State Notice of Rights.
A declaration of removal request must include the following:
- A statement that you are a victim of identity theft
- A statement that you are eligible for removal of information due to identity theft
- You must specifically identify the information you are requesting be removed
- A statement that you are available for service of process at a conclusively valid designated address for at least 30 days

When submitting a declaration of removal, you must also include a copy of one form of documentation from each of the categories below:
Identification Validation
- Valid driver's license
- Valid state issued identification
- Social Security card
- Passport
- Military ID
- Pay stub
- W2
Address Validation
- Valid driver's license
- Valid state issued identification
- Utility bill that displays correct address (electric, water, gas, cable, residential telephone, etc.)
- Mortgage statement
- Rental agreement
- Deed
- Bank statement
