New Mexico Declaration of Removal

A declaration of removal is defined as an identity theft report with a sworn affidavit.

If you are a current resident of New Mexico, you have a right to submit a declaration of removal regarding any information contained in your consumer file that you believe is a result of identity theft. Select the following link to view the complete New Mexico State Notice of Rights.

A declaration of removal request must include the following:

  • A statement that you are a victim of identity theft
  • A statement that you are eligible for removal of information due to identity theft
  • You must specifically identify the information you are requesting be removed
  • A statement that you are available for service of process at a conclusively valid designated address for at least 30 days

When submitting a declaration of removal, you must also include a copy of one form of documentation from each of the categories below:

Identification Validation

  • Valid driver's license
  • Valid state issued identification
  • Social Security card
  • Passport
  • Military ID
  • Pay stub
  • W2

Address Validation

  • Valid driver's license
  • Valid state issued identification
  • Utility bill that displays correct address (electric, water, gas, cable, residential telephone, etc.)
  • Mortgage statement
  • Rental agreement
  • Deed
  • Bank statement
